PURCHASE AGREEMENT AND ACKNOWLEDGMENT OF TERMS

This Purchase Agreement is entered into between Southwest Horse Sale, LLC (“Auction Company”) and the undersigned purchaser (“Buyer”).

Buyer hereby acknowledges and confirms the purchase, at public auction conducted by Southwest Horse Sale, LLC, of the horse identified on the accompanying sales invoice, which is incorporated into this Agreement by reference.

By signing this Agreement, Buyer expressly acknowledges and agrees that Buyer has read, understands, accepts, and agrees to be bound by all Sales Terms and Conditions published on the Southwest Horse Sale, LLC website, printed in the sale catalog, contained in the Buyer's Contract, and announced by the auctioneer at the commencement of the auction. Such terms and conditions are incorporated into this Agreement by reference.

Buyer further acknowledges and agrees that Southwest Horse Sale, LLC shall have the authority to review and make the final determination regarding any disputes, disagreements, or claims arising from or relating to the auction transaction, including the interpretation and application of the Sales Terms and Conditions, to the fullest extent permitted by applicable law. No charge backs are allowed on any form of payment.  Buyer acknowledges and agrees that all sales are final and that all credit card and debit card payments are authorized and binding.
